A surrogacy agreement covers a wide variety of issues:

  • It establishes that the Intended Parents are the legal parents of the child.
  • Selection of medical providers and medical facilities, including the delivery hospital.
  • The number of embryos transferred in any individual embryo transfer procedure.
  • Selection of an insurance policy, as well as information regarding the review of the insurance policy by a professional to confirm coverage;
  • Sensitive topics such as termination of pregnancy and selective reduction.
  • Reasonable pregnancy related restrictions on the surrogate’s activities and conduct during the pregnancy.
  • Expectations regarding of the involvement of the intended parents in the pregnancy, including attending medical appointments and delivery.
  • Compensation and reimbursement of any expenses.

About Parental Orders

A surrogacy agreement alone is not enough for intended parents to be the legal parents of the child. What is ultimately needed is a court order, which establishes legal parentage and also states that the intended parents shall be listed on the child’s birth certificate. A parental order may be issued pre-birth or post-birth (legal requirements will depend on the state).

Requirements for obtaining a parental order in California also vary by county. I am familiar with the policies, procedures, and requirements of counties throughout California.

I also coordinate with the delivery hospital to ensure that court judgment is received and accepted, so that the parties can focus solely on the delivery.
