Gestational Surrogacy
The surrogate carries an embryo she has no genetic connection to, which is the most common path and the one California law handles most cleanly. We draft and negotiate the gestational carrier agreement, coordinate with your clinic and agency, and file the pre-birth order that puts intended parents on the birth certificate from day one. Everything gets settled before the baby arrives, not after.
Traditional Surrogacy
Here the surrogate uses her own egg, which makes her a genetic parent and changes the legal picture considerably. These arrangements require more careful contracting and usually a post-birth adoption or parentage proceeding. We’ll walk you through the added risk honestly before you commit to this route.
Egg / Embryo Donation
Whether you’re donating or receiving, the agreement needs to spell out parental rights, future contact, and what happens to any remaining embryos. Known donor arrangements are where things get complicated fast, because an informal agreement between friends often will not hold up. When a child is born in one state and will live in another, the Interstate Compact on the Placement of Children (ICPC) governs the move, and you cannot bring the child home until it clears. Interstate Surrogacy
Surrogacy law varies enormously state to state, and your match may not live where you do. We identify which state’s law will govern, coordinate with local counsel where needed, and make sure the parentage order will be recognized where you live. Getting the jurisdiction right early is most of the battle.
